Baker charges R$ 76 for cupcakes in court, but is ordered to pay R$ 1,500 for calling client a 'deadbeat'
A baker in Rio Grande do Norte won a court ruling to charge a customer for unpaid cupcakes but was penalized for publicly insulting her on social media.
A recent court ruling in Rio Grande do Norte highlights a unique legal dispute involving a baker and a customer over an unpaid order. The case began when a baker sought reimbursement of R$ 76 for 20 cupcakes that a customer ordered but failed to pick up or pay for. While the court ruled in favor of the baker to recover this amount, it also found the baker at fault for publicly labeling the customer as a 'caloteira,' or deadbeat, on social media, leading to a separate judgment for defamation.
Judge Deonita Antuzia Fernandes presided over the case in the Canguaretama Special Civil Court, where she noted that while the customer’s failure to pay constituted a material loss, the baker’s actions went beyond fair collection practices. The judge deemed that the public insult not only damaged the client’s reputation but also crossed legal boundaries, prompting the additional penalty of R$ 1,500 in damages payable to the client.
This case underscores the complexities involved in minor civil disputes and the importance of maintaining professional conduct in business transactions, particularly in the age of social media. It serves as a warning for small entrepreneurs about the potential repercussions of public comments that may be seen as defamatory, even when pursuing legitimate claims for payment.
