Driver caught with over 400 kg of cocaine is released and sentenced to alternative punishment

A driver caught with 419 kg of cocaine has been sentenced to an alternative punishment instead of prison time after being classified as a first-time offender and merely a transporter of the drug.

A motorist has been caught transporting 419 kg of cocaine on the MGC-497 highway in Brazil, between Honorópolis and Campina Verde, a vast quantity concealed among iron ore in a heavy-duty truck. After his arrest in December 2025, he claimed to have been paid R$ 5,000 to transport the drugs from the Bolivian border to Bambuí, indicating a cross-border drug trafficking operation. Despite the large amount of narcotics, the ruling Judge José Humberto Ferreira of the 1st Federal Criminal Court in Uberlândia viewed the driver as a first-time offender and merely a carrier of the drugs.

The judicial decision made headlines due to the controversial nature of the sentencing. Rather than imposing the standard two-year prison term, the judge opted for a lesser penalty associated with so-called ‘privileged trafficking.’ This included community service and a monetary fine of R$ 10,000 instead of incarceration. The judge also revoked the driver's preventive detention and ordered his immediate release, stating that his situation and cooperation justified a more lenient sentence, despite the drug quantity involved.
