Marcola, leader of PCC, requests Justice to extend benefit granted to Vorcaro in DF

Marcola, the alleged leader of the criminal gang PCC, has requested that the same legal benefits granted to businessman Daniel Vorcaro be extended to him regarding communications with his lawyers.

Marco Willians Herbas Camacho, known as Marcola, who is identified by authorities as the leader of the First Command of the Capital (PCC), has formally requested the Brazilian Federal Court to extend legal privileges that were recently granted to entrepreneur Daniel Vorcaro concerning confidential communications with his legal representatives. On October 12, his lawyer, Bruno Feullo Rita, submitted the petition, pointing out that Marcola is currently incarcerated in the federal penitentiary in Brasília alongside Vorcaro.

The request comes after a decision by Federal Minister André Mendonça, who allowed Vorcaro to have visits from his legal counsel without surveillance or recording of conversations, a privilege that is typically not afforded under federal prison regulations where meetings are usually recorded in audio and video. The decision provided to Vorcaro, who was transferred to a federal facility on October 6, highlights a notable exception to existing rules governing attorney-client interactions which ordinarily prohibit such monitoring.

Marcola's petition raises significant questions about the interpretation and application of legal protections for prisoners, particularly those in high-profile cases connected to organized crime. If the court grants Marcola's request, it could set a precedent for how similar cases are handled in the future, particularly for members of criminal organizations. This scenario emphasizes ongoing discussions regarding prisoners’ rights and the balance between security protocols in correctional facilities and the legal rights to confidential legal counsel.
