The Justice ordered compensation for the man who lost part of a finger when reclining the seat on a bus
A court in La Plata has ordered substantial compensation to a man who suffered a partial amputation of a finger while attempting to recline his bus seat due to a technical defect.
In a landmark ruling, the First Civil and Commercial Appeals Chamber of La Plata has mandated substantial compensation for a man who lost part of his finger while trying to recline his bus seat. The incident occurred in June 2015 when the victim, a 27-year-old psychology resident, attempted to adjust his seat back during his daily commute. Unfortunately, a technical fault in the seat's mechanism resulted in the amputation of the distal phalanx of his left ring finger. He was later diagnosed with partial and permanent disability due to the injury.
The court acknowledged the complaint for physical damages stemming from the incident but adjusted the initially proposed compensation amount set by the lower court. This ruling underscores the responsibility of transport companies to ensure the safety and proper functioning of their equipment, especially in public transport, where passengers are vulnerable to such accidents.
As the case highlights, consumer rights and safety standards are critical in the transport industry. The decision not only serves as a reminder of the potential risks associated with public transportation but also indicates the judicial system's commitment to safeguarding the rights of individuals. Victims of similar incidents might find hope for legal recourse in future cases, paving the way for greater accountability from service providers.
