Court orders company to compensate driver after mechanical arm of truck hits parked car
A court in Campo Grande ruled that an engineering company must compensate a driver injured when a truck's mechanical arm struck his parked vehicle.
In Campo Grande, Brazil, a district court has ruled in favor of a worker who was injured in a traffic accident involving a truck's mechanical arm. The incident occurred on Avenida Prefeito Lúdio Martins Coelho while the victim was parked and carrying out his work. The mechanical arm, which had become detached from the truck, struck the side of his car, causing it to overturn and be dragged for approximately 20 meters.
The accident left the driver with multiple injuries, necessitating surgeries and a four-month absence from work for recovery. Despite undergoing treatment, the driver sustained moderate long-term effects, including partial loss of strength and movement in his left wrist. This led to the court's decision against the engineering company and the truck's owner, emphasizing the responsibility of both parties for ensuring the safety of their equipment.
Judge Marcel Henry Batista de Arruda of the 9th Civil Court highlighted the importance of accountability in such accidents and the legal implications for companies operating machinery. The ruling serves as a reminder of corporate liability in ensuring the proper functioning of their vehicles and the potential penalties for negligence, ultimately aiming to protect workers and uphold justice in similar cases.
