The Return of Auchan in Place of Former Real Stores. The Matter is Being Monitored by UOKiK

Auchan is replacing former Real stores in Poland, which raises regulatory scrutiny.

In 2014, the Polish Office of Competition and Consumer Protection (UOKiK) approved Auchan’s acquisition of Real hypermarkets under the condition that eight stores would be sold to a non-affiliated operator to prevent market monopolization. These stores were subsequently taken over by the French group Schiever and operated under the Bi1 brand for several years. However, one of these stores, located in Sosnowiec, was demolished without ever adopting the Bi1 branding, highlighting potential lapses in regulatory compliance. In 2021, Rella Investment opened a newly built hypermarket in Ełk, with an investment of 30.5 million PLN.

Recently, Auchan Polska signed a franchise agreement for eight hypermarkets previously operating under the Bi1 brand, which increases the number of Auchan-branded stores in Poland to 80. This development demonstrates Auchan’s expanding market presence in Poland, which could again attract the UOKiK's attention, given the previous conditions of their acquisition and the agency’s mandate to regulate competition within the retail sector.

Additionally, UOKiK has raised concerns about potential anti-competitive behavior by three real estate companies, which adds another layer to the already complex interaction between retail chains and regulatory frameworks in the Polish market. This situation reflects ongoing challenges in balancing corporate expansion with consumer protection laws.
