Luxury resort in Tiradentes ordered to pay over R$ 40,000 to family due to accident on water slide that injured mother and child
A luxury resort in Brazil has been ordered to compensate a family after a water slide accident led to injuries to a mother and her child.
The Santíssimo Resort, a luxury hotel in Tiradentes, Minas Gerais, Brazil, has been found liable by a Rio de Janeiro court for safety failures after an accident on a water slide injured a mother and her child. The court has mandated that the resort pay R$ 25,000 in moral damages for the distress caused to the family and cover R$ 11,973.04 in medical expenses incurred due to the accident. In addition, the resort is required to refund R$ 3,144 for the unused nights of the family's stay following their premature departure due to the incident.
The incident, which occurred in July 2022 at the hotel's newly opened water park, involved the mother and child being ejected from the slide during their descent. Fortunately, the mother was able to grasp her child, but they both struck a support post situated within the pool area, leading to their injuries. The ruling highlights significant concerns regarding the safety measures in place at the resort's recreational facilities that may have contributed to the accident and subsequent injuries suffered by the guests.
This case exemplifies the broader issues of guest safety and the responsibilities of entertainment and hospitality venues in Brazil. With increasing levels of tourism and investment in luxury accommodations, resorts and similar establishments are under heightened scrutiny to ensure the safety of their attractions. This ruling might prompt a review of safety protocols across similar facilities in Brazil, ensuring that guests are adequately protected from potential harm during their leisure activities.
