Court orders compensation of R$ 120,000 and lifetime pension for victim of medical negligence in maternity hospital in RN
A court in Rio Grande do Norte determined compensation and a lifetime pension for a victim of medical negligence from 19 years ago.
Nineteen years after a case of medical negligence occurred in a maternity ward in São Gonçalo do Amarante, a court in Rio Grande do Norte has mandated that the state and the health unit pay R$ 120,000 in damages and a lifetime pension to the victim, who is now 19 years old. The ruling by the 2nd Civil Chamber of the Court of Justice of Rio Grande do Norte upheld the first instance decision, which required R$ 60,000 for moral damages and R$ 60,000 for aesthetic damages to be paid to the victim's parents, in addition to a monthly pension equivalent to a minimum wage starting from the victim's 14th year.
The mother of the victim reported that she sought prenatal care and took necessary precautions to ensure her child's safety during childbirth. Despite these efforts, the medical negligence experienced during labor resulted in permanent damage to the victim’s health.
