Engineer responsible for water slide construction where boy died is acquitted
The engineer responsible for a water slide in which an 8-year-old boy died has been acquitted by the courts in Brazil.
An engineer, Flávio Tomaz de Aquino Musse, has been acquitted of culpable homicide in relation to the death of 8-year-old Davi Lucas de Miranda at a water park in Caldas Novas, Goiás. The court found that Musse did not have direct responsibility for the incident which occurred on February 10, 2022, when the child fell from the slide known as "Vulcão". While the evidence presented during the trial indicated that the removal of a safety barrier around the slide contributed to the accident, it was determined that this action was ordered by the park's manager without Musse's knowledge.
The case has drawn attention not only due to the tragic circumstances of the boy's death but also the implications for safety regulations at amusement parks. The prosecution, represented by the Public Ministry of Goiás, has expressed its disagreement with the ruling and plans to appeal the decision. This highlights ongoing concerns regarding accountability and adherence to safety measures in similar facilities, and whether sufficient oversight is in place to prevent such incidents from occurring in the future.
The incident raises questions about the responsibility of construction professionals and park management, and the need for clear communication and protocols around safety within recreational environments. The potential appeal by the Public Ministry further complicates the situation, leaving open the possibility of further legal scrutiny and public debate around the safeguards in place to protect young patrons in amusement parks.
