Justice maintains conviction of the State of SP for facilitating child labor in schools in Porto Feliz
The São Paulo State was sentenced to pay R$ 2 million for facilitating child labor in schools of Porto Feliz, according to a ruling by the Labor Court.
The Labor Court upheld the conviction of the State of São Paulo for its permissive attitude towards child labor involving students in public schools in Porto Feliz. This decision by the Regional Labor Court of the 15th Region concluded that schools were complicit in altering students' schedules, allowing them to work in prohibited activities such as construction and in butcher shops. This ruling is significant as it highlights the systemic issues surrounding child labor in educational institutions.
Moreover, the court ordered the state to pay a substantial fine of R$ 1 million for collective moral damages. The investigation led by the Ministry of Public Labor uncovered that adolescents aged 14 to 16 were engaging in work without formal contracts and under hazardous conditions. These findings raise serious concerns about the enforcement of labor laws and the protection of minors, emphasizing the state’s responsibility in safeguarding students' rights.
The ruling not only imposes financial penalties but also mandates new obligations aimed at preventing future violations. While the state has the option to appeal the decision, this case underscores the ongoing struggle against child labor in Brazil and the need for stricter regulations and oversight to protect the most vulnerable members of society, particularly in educational contexts.
