Elections to the Constitutional Tribunal. PiS Candidate Without Recommendation

During a recent meeting, the committee gave positive recommendations to several candidates for the Constitutional Tribunal while rejecting one from PiS.

During a session on Thursday, the committee provided positive recommendations for all candidates nominated by the Presidium of the Sejm, including judges and lawyers like Krystian Markiewicz and Maciej Taborowski. While Dr. Michał Skwarzyński, nominated by the Law and Justice party (PiS), received a favorable opinion, the committee issued a negative recommendation for another PiS candidate, Professor Artur Kotowski, from the Cardinal Stefan Wyszyński University’s Faculty of Law and Administration.

On Friday, the Sejm is set to choose six judges for the Constitutional Tribunal from among the candidates presented. However, prior to the selection, the ruling coalition intends to adopt a resolution regarding the Constitutional Tribunal. This resolution aims to assert that the Tribunal has ceased to fulfill its role as an impartial and independent body serving the citizens of Poland, in light of constitutional standards and the applicable international and European standards.

This ongoing controversy over the Tribunal's independence reflects broader tensions in Polish politics, particularly regarding the judicial system and its relationship with the ruling party. The implications of these changes could have lasting effects on the rule of law and the separation of powers in Poland, raising concerns among opposition parties and civil society organizations about the future of democracy in the country.
