[Exclusive] Scottish Pension Fund that lost $7 million from Coupang incident has fully launched a lawsuit in the U.S.

The North East Scotland Pension Fund (NESPF) has stepped forward as a lead plaintiff in a U.S. securities class action lawsuit against Coupang, following significant losses due to the company's stock price drop triggered by a data breach.

In the wake of a significant data breach at Coupang that led to a dramatic drop in its stock price, individual investors have initiated a securities class action lawsuit in a U.S. court. The North East Scotland Pension Fund (NESPF), managed by Aberdeen City Council, is now seeking to be designated as the lead plaintiff in this case, which could enhance pressure on Coupang's management. Given that the NESPF has substantial financial resources and legal expertise, its involvement may indicate a more rigorous pursuit of accountability from Coupang, compared to individual investors.

The NESPF reported that they acquired 720,411 shares of Coupang during the period in question (from May 7 to December 16 of last year), incurring losses amounting to approximately $7 million. In contrast, individual investors in the lawsuit have reported losses averaging around $37,200, highlighting a significant disparity in the financial stakes involved. The selection of a lead plaintiff in securities class actions often favors those who hold a larger economic interest in the case, making the NESPF's chances of becoming the lead plaintiff quite high. A decision on this designation is anticipated next month.

The participation of a Scottish pension fund in this lawsuit could potentially change the dynamic of the proceedings. The Private Securities Litigation Reform Act (PSLRA), enacted in 1995, strongly encourages institutions with substantial resources and expertise to take on lead plaintiff roles. This approach allows for more effective control of the plaintiff's legal representation and aims to maximize the interests of all shareholders. The NESPF has previously successfully assumed a lead plaintiff role against other companies, demonstrating its capacity to impact large settlements, such as a class action against Under Armour that resulted in a $434 million payout.
