A woman has been awarded R$ 150,000 in damages after experiencing severe failures during childbirth that resulted in the loss of her baby at a maternity hospital in São João do Piauí.
A woman in São João do Piauí has been awarded R$ 150,000 for moral damages following serious errors made during her childbirth at Municipal Maternity Mãe Elisa. The decision was announced by the Public Defender's Office of the State and dates back to February 10. The incident occurred in July 2021 when a medical team decided to proceed with a vaginal delivery despite prior medical recommendations for a cesarean section due to the woman's medical history.
The child's death, claimed by legal counsel, was attributed to this decision, which blatantly disregarded medical advice that indicated the higher risks associated with a normal delivery in her case. In addition to the emotional turmoil, the legal team highlighted both material and moral damages resulting from the medical team's actions, arguing that the woman had completed regular prenatal care and had a valid reason for the surgery that was ignored by the practitioners present.
As of now, the municipal government of São João do Piauí has not provided any comment on the court's ruling. This case raises significant concerns regarding maternal health protocols and the adherence to medical guidelines, emphasizing the need for rigorous standards in childbirth practices to prevent such tragedies in the future.
