Santa Joana Hospital to pay millions after agreement with the Public Ministry in case involving twin's death
Santa Joana Hospital in Brazil will pay R$ 1.2 million for failing neonatal care following the death of a newborn due to asphyxiation.
Santa Joana Hospital, located in SΓ£o Paulo, Brazil, has reached an agreement with the Public Ministry, following an investigation into failures in neonatal care that resulted in the death of a newborn in July 2023. The settlement includes a payment of R$ 1.2 million for collective moral damages and mandates the hospital to implement significant structural and operational improvements. This agreement underscores the hospital's commitment to enhancing patient care in the wake of serious incidents.
In a statement to G1, the hospital emphasized that the agreement was made with full cooperation and stressed that the signing of the Conduct Adjustment Agreement (TAC) does not imply an admission of wrongdoing in the care provided to the deceased newborn, Davi. Despite the controversy surrounding the case, the hospital maintains its belief in the strength of its defense and asserts that the truth of the situation will ultimately prevail.
The troubling circumstances surrounding Davi's death have raised significant concerns, particularly as his mother, an otolaryngologist, alleges that he succumbed to asphyxiation after choking on his own vomit. Fortunately, his twin sister, Lara, remains healthy. This case not only highlights specific failures within the hospital's neonatal unit but may also prompt broader discussions around the standards of maternal and neonatal care in Brazil, given the implications for patient safety and accountability in the healthcare system.
