Justice releases R$ 1.4 billion to pay INSS arrears; see who receives

The Brazilian Justice Council has released R$ 1.4 billion to pay overdue benefits to INSS beneficiaries who won their cases against the institute.

The Brazilian Federal Justice Council (CJF) has authorized the release of R$ 1.4 billion for overdue payments owed to beneficiaries of the National Social Security Institute (INSS), including retirees and pensioners. This funding is aimed at settling claims for those individuals who successfully contested the institute in legal actions related to the granting or revision of their benefits. Approximately 87,000 insured individuals will benefit from this decision, which pertains to 65,300 cases where the beneficiaries emerged victorious against the INSS in court.

Payments will be made through Requests for Small Value (RPV), which are designed for overdue amounts of up to 60 minimum wages, totalling R$ 97,260 this year. The payments encompass a variety of benefits such as retirement pensions, aid, and Continuous Cash Benefit (BPC). Eligibility for these funds is restricted to those who had their legal actions ruled in their favor, with a payment order issued by the judge during January. The deposits are anticipated to be made into the accounts of the beneficiaries or their attorneys by the beginning of March.

In total, the CJF has allocated R$ 1.8 billion for this initiative, covering payments to 149,100 citizens who have successfully challenged the government in 119,700 legal proceedings. This release of funds not only addresses aspects of social security litigation involving the INSS but also signifies the government's commitment to resolving outstanding legal claims and the importance of judicial rulings in protecting the rights of citizens regarding social insurance benefits.
