The next step towards a fully automated debt collection application process
The Latvian Saeima supported amendments to the Civil Procedure Law to implement a fully automated debt enforcement application process in the court information system.
On Thursday, the Latvian Saeima approved, in the first reading, amendments to the Civil Procedure Law that aim to introduce a fully automated debt collection application process within the Court Information System (TIS). This initiative seeks to alleviate the burden on the judiciary and reduce administrative responsibilities. The proposed changes focus on the automation of the debt enforcement warning procedure in uncontested cases where the debtor admits the debt and there is no substantive legal dispute.
The new system will handle the submission of applications, formal data validation, and notification delivery based on legally established criteria. In such cases, the validity of the debt, evidence, or party arguments will not be evaluated; instead, the outcome of the process will rely on the fulfillment of designated criteria and the debtor's response. This automation is expected to free up resources within the courts for cases with genuine disputes, enhancing overall judicial efficiency.
As outlined in the amendments, decisions will be generated online and certified electronically with a qualified electronic seal. These changes mark a significant step forward in modernizing the legal processes associated with debt collection in Latvia, potentially expediting resolution times and reducing operational costs for the legal system.
