Educational Protocol

Ecuador's Constitutional Court has mandated the Ministry of Education to create a protocol to prevent discrimination based on sexual diversity and gender identity among children and adolescents, prompting a review of existing educational policies.

The Ecuadorian Constitutional Court issued ruling n.° 95-18-EP/24 on November 28, 2024, which requires the Ministry of Education to establish a support protocol aimed at preventing and combating discrimination relating to sexual diversity and gender identity for children and adolescents. This ruling led to the implementation of Ministerial Agreement n.° MINEDEC–2025-00045-A by former Minister Dr. Alegría Crespo on September 24, 2025. The initiative reflects an effort to create a more inclusive educational environment in accordance with judicial instructions.

However, the introduction of this protocol sparked considerable controversy, which prompted the Ecuadorian Ministry of Education to undertake a thorough review of its contents. The core controversy stemmed from a misunderstanding concerning the intent of the Constitutional Court's decision. While the court mandated actions to prevent discrimination within educational settings, there was no directive to redefine identity categories or to enforce new school practices beyond what was necessary for compliance with the ruling.

The subsequent technical review of the protocol revealed certain provisions that extended beyond the judicial mandate, which raised concerns among stakeholders regarding potential overreach. This situation illustrates the challenges educational authorities face when implementing significant policy changes while balancing judicial edicts and public sentiment in a culturally sensitive context.
