Renewable Energy Companies Penalized. UOKiK: Sold Clean Energy with Fear and Deception

Poland's UOKiK has penalized companies in the renewable energy sector for misleading advertising practices that exploited consumer fear.

The Polish Office of Competition and Consumer Protection (UOKiK) recently reported that some companies in the renewable energy sector have engaged in deceptive marketing practices, using fear tactics to sell clean energy solutions. The agency determined that these companies misled consumers by burying crucial conditions in fine print and framing their advertisements as official communications. As a result, two firms, including Poland Energy Capital Group, faced fines exceeding 900,000 PLN for misleading advertising practices.

Specifically, the UOKiK highlighted that Poland Energy Capital Group utilized advertisements that mimicked official government letters, leading to potential confusion among consumers. These communications were designed to resemble official documents and featured formal titles like "Announcement" or "Notification," along with conspicuous red labels stating, "Notification for residents of the municipality." This misleading communication strategy could easily mislead individuals into believing they were receiving correspondence from a government entity or energy distributor rather than a private company's marketing offer.

The findings by UOKiK underscore the importance of transparent marketing practices in the renewable energy industry. The agency's actions not only aim to protect consumers from fraudulent practices but also serve as a warning to other firms in the sector.
