UOKiK penalizes universities. Students have a chance to recover funds
The UOKiK has imposed penalties on the University of SWPS and Lublin University of Technology for illegally raising tuition fees, allowing affected students to reclaim overpaid amounts.
The Office of Competition and Consumer Protection (UOKiK) in Poland penalized two universities: the University of SWPS in Warsaw and the Lublin University of Technology, for unlawfully increasing tuition fees during a period when legal regulations prohibited such actions. Specifically, students at these institutions experienced tuition hikes in violation of established agreements that guaranteed fixed fees from enrollment to graduation. Following UOKiK's ruling, both universities are required to refund students the excess amounts they charged beyond the tuition fees agreed upon at the time of their admission.
The investigation revealed that between the years prior to September 2023, these universities had raised tuition fees contrary to the legal framework intended to protect students from unexpected financial burdens. The regulation in question ensured that once the tuition fee was set, it could not be altered for the duration of a student's course. The repercussions are significant as they not only affect the universities' reputations but also their financial stability as they must allocate funds for the refunds.
This decision represents a substantial victory for student rights in Poland, reinforcing the principle of transparency and fairness in educational costs. The UOKiK's action could set a precedent for stricter monitoring of tuition policies across the country, compelling other institutions to adhere more rigidly to existing laws and potentially curbing future infringements. Additionally, avenues for students to recover their overpaid fees are now clearer, empowering them to take action against institutions that violate their rights.
