WhatsApp has announced that small and medium enterprises will subsidize major AI companies like OpenAI following a regulatory decision against its chatbot messaging fees in Brazil.

After the Brazilian Administrative Council for Economic Defense (Cade) ruled that WhatsApp violated a preventive measure by charging for messages sent by AI chatbots, Meta's subsidiary, WhatsApp, stated that small and medium businesses currently subject to these fees would be subsidizing larger AI companies like OpenAI. This decision has raised concerns about the impact on competition among AI service providers.

In a technical note released on Wednesday, Cade's General Superintendence clarified that WhatsApp and Facebook breached the requirements by initiating these charges before the council completed its assessment. According to the Superintendence, WhatsApp's unilateral fee policy could lead to anticompetitive effects by favoring Meta's own AI solution, Meta AI, which operates without facing the same fees imposed on its competitors.

As a result of this infraction, Cade imposed a fine of R$ 250,000 per day for each day that WhatsApp maintains charges on businesses utilizing chatbots. WhatsApp's disagreement with this ruling highlights the ongoing tension between regulatory frameworks and big tech companies, particularly in how they operate within Brazil's digital economy.
