Pregnant employee who was insulted with comments 'ugly belly' and 'disabled child' must be compensated, determines Justice
A pregnant employee who faced derogatory comments at a Burger King franchise in Goiânia, Brazil, is set to be compensated for moral harassment by a court ruling.
In a recent ruling by the Regional Labor Court of Goiás (TRT-GO), a former employee of a Burger King franchise in Goiânia has been awarded compensation for suffering moral harassment while pregnant. The young woman, aged 21 at the time, endured derogatory remarks from her manager, who criticized her appearance by calling her belly 'ugly' and made distressing comments about her unborn child potentially being 'disabled'.
The court decided that the young woman should receive R$ 5,000 for the moral harassment, with the total compensation amounting to over R$ 22,000. This total includes not only damages for the harassment but also pays for the indirect termination of her employment. Her attorney, Igor Matheus Rodrigues de Sousa Rezende, emphasized the case's significance, highlighting that it sheds light on workplace discrimination and the need for better protections for pregnant employees.
This decision is a vital step toward acknowledging and addressing the serious issue of moral harassment in the workplace, especially regarding vulnerable groups such as pregnant women. It raises awareness about the ethical and legal responsibility of employers to provide a respectful and safe work environment, and could potentially lead to more stringent policies against such behaviors in Brazilian workplaces.
