Three-Year Sentence Confirmed for 'Gyujaeok's Threat Against Tzu-yang,' Request for Judicial Review Filed

YouTuber Gyujaeok has filed a request for a judicial review after being sentenced to three years in prison for extorting money from fellow YouTuber Tzu-yang.

Gyujaeok, a YouTuber whose real name is Lee Jun-hee, was sentenced to three years in prison for threatening fellow YouTuber Tzu-yang (real name Park Jung-won) and extorting 55 million KRW. Tzu-yang reported that Gyujaeok threatened to expose details about her personal life unless she paid him, leveraging his threat to secure money under the guise of protecting her from online harassment. Both the first and second trials confirmed Gyujaeok's guilt, citing that he took advantage of the victim’s vulnerabilities in a manner that was ethically reprehensible, particularly given the amount of money involved. On December 12, the Supreme Court upheld the lower court's ruling, asserting that no errors occurred during the trial processes which would merit a reversal of the decision. Gyujaeok's lawyer, Kim So-yeon, argued that evidence collected during the digital forensic process violated legal principles because it included unrelated personal messages and private information, thus infringing Tzu-yang's rights to privacy and self-determination over her personal data, as guaranteed by the Constitution. Kim claims that such usage of evidence is contrary to the exclusionary rule that prohibits the admission of illegally obtained evidence. In reaction to the judicial request filed by Gyujaeok, Tzu-yang’s lawyer, Kim Tae-yeon, stated that they are considering how to respond, including submitting a counter-argument. Kim expressed concern for Tzu-yang, noting that she felt a momentary relief from the sentence until learning about Gyujaeok’s request for review, leading to renewed anxiety over the legal proceedings and the potential for prolonged distress due to re-litigation. The statement underscores the emotional toll that such serious allegations and the ensuing legal battles can have on victims, reinforcing the need for a systemic approach to support their rights during and after the process.
