Regions fined after deal on record-keeping system
The Gothenburg Administrative Court has imposed fines on nine regions for entering into a contract for the Cosmic record system without a proper procurement process.
The Gothenburg Administrative Court has ruled that nine regions in Sweden must pay fines of ten million kronor each for entering into a contract for the Cosmic record system without conducting a procurement process. This decision comes after the regions were found to have violated the law while pursuing their agreement with Cambio, the company behind the Cosmic system.
The ruling highlights significant concerns regarding compliance with procurement laws, as the regions had the option to enforce penalties when Cambio informed them in late 2022 that the system could not be delivered on time. Instead of seeking penalties, the regions opted to enter into a new agreement with Cambio, which raised further questions about the legality of their actions. The Competition Authority of Sweden indicated that the modifications made to the initial contract were substantial enough to necessitate a new procurement process.
