OAB-SP now proposes digital ethics code to STF amid wear of the Master case

The OAB-SP has proposed a new digital ethics code to the Brazilian Supreme Court aimed at improving conduct among its members.

The OAB-SP (Brazilian Bar Association of São Paulo) has presented a new suggestion to the Supreme Federal Court (STF) for a digital ethics code aimed at regulating the behavior of court ministers. This initiative comes at a time of scrutiny surrounding the so-called Master case, which has raised questions about judicial conduct in the digital era. In January, the OAB-SP had already submitted a code of conduct proposal to the court's president, Edson Fachin, reflecting ongoing efforts to enhance judicial ethics and accountability.

The new proposal focuses on various aspects of digital communication among ministers, including their public posts on social media and private communications via messaging apps. The OAB-SP emphasizes the need for security measures in the digital realm and advocates for transparency in process distribution systems. These regulations aim to prevent conflicts of interest and establish a cooling-off period for ministers leaving their roles, giving them time away from the judiciary before engaging in private legal practice.

The code was developed based on a study led by attorney Ronaldo Lemos, who is also a columnist for Folha. This collaborative effort highlights the increasing recognition of the importance of maintaining ethical standards and integrity within Brazil's judicial system, particularly as it navigates the complexities of modern technology and public scrutiny. By proposing these rules, the OAB-SP seeks to enhance the credibility of the judiciary and address concerns related to digital ethics and judicial transparency.
