The Ethics Tribunal of OAB-SP will analyze whether a lawyer should declare proximity to a judge after the Toffoli case
The OAB-SP is set to review ethical guidelines regarding the relationship between lawyers and judges, particularly in light of a situation involving a travel scenario with a Supreme Court minister.
The Brazilian Bar Association in São Paulo (OAB-SP) is preparing to analyze a consultation regarding the ethical boundaries in the relationships between lawyers and judges. This inquiry highlights a hypothetical scenario involving a private jet trip with a minister of the Brazilian Supreme Court (STF) and a lawyer connected to the Bank Master case. The OAB-SP, led by its president Leonardo Sica, emphasizes that this discussion is not tied to any specific incident but aims to clarify potential ethical dilemmas that could arise within the profession.
The issue has been brought to the forefront following a previous controversial incident involving Minister Dias Toffoli, who was reported to have taken a private jet trip to Peru with a lawyer linked to the Bank Master case. The consultations and discussions are intended to assess whether lawyers should be required to declare such relationships with judges, which raises significant questions about conflicts of interest and the integrity of legal proceedings.
Sica underscored the need for an updated code of conduct for judges, indicating that clarifying the ethical responsibilities of lawyers could improve transparency and public trust in the judiciary and the legal profession. The meetings scheduled for March will aim to produce guidelines that ensure ethical standards are maintained while promoting accountability among legal practitioners.
