Supreme Court: Landlords who condone unreported lodging operations by tenants must repay reduced acquisition tax

The South Korean Supreme Court ruled that landlords are responsible for unpaid acquisition taxes if their tenants operate lodging businesses without notification.

The South Korean Supreme Court has made a significant ruling regarding landlords and their responsibilities for tenants who conduct unreported lodging operations. In a case involving a landlord identified as Mr. K, the court upheld a lower court's decision that the landlord should be held liable for taxes owed when tenants use rental properties for commercial activities without disclosure. This ruling emphasizes that even if the landlord was initially exempt from certain taxes, they can be called to account if they are aware of and allow their property's misuse.

Mr. K had purchased an officetel in Busan and received a tax exemption under the previous Local Tax Special Treatment Limitation Act. However, from June 2020 to March 2023, he rented the property to tenants who operated an unreported lodging business that ultimately led to criminal penalties. The local government assessed Mr. K for taxes amounting to approximately 18.84 million won, asserting that he was complicit in the tenants' illegal operations due to his role as the property manager. The case escalated through the courts, with the first instance finding in favor of Mr. K, but the appellate court later reversed that decision, stating that Mr. K's awareness of the situation implied his responsibility.

The South Korean Supreme Court's ruling underscores the legal expectations placed on landlords to ensure that their properties are used for legitimate purposes. This decision may motivate future landlords to be more vigilant about their tenants' activities and could lead to increased scrutiny of rental agreements. The implications of this ruling extend beyond the individuals involved, potentially influencing legislation and enforcement related to rental properties and business operations in South Korea.
