IESS: Appeal hearing for the appointment of the insured representative will take place in June

The appointment of Jorge Moncayo as the insured representative at the Ecuadorian Institute of Social Security (IESS) is still under judicial dispute, with an appeal hearing scheduled for June 19.

The legal dispute surrounding the appointment of Jorge Moncayo as the insured representative on the Board of Directors of the Ecuadorian Institute of Social Security (IESS) continues to evolve within the judicial system. An appeal hearing has been set for June 19, in response to a ruling made by Judge Betsy Farías on January 23, which favored Moncayo in an action for protection that allowed his appointment to IESS. This means that the appeal will take place five months after the initial ruling.

The case is currently under the jurisdiction of a specialized labor court in the Provincial Court of Justice of Manabí, following appeals lodged by IESS authorities, the Superintendent of Banks, and the Attorney General's Office against Judge Farías’s decision. Moncayo officially assumed the position as the representative of the insured on March 5, as indicated in an internal memorandum from IESS which this newspaper has accessed, mentioning that his appointment has become a contentious issue in Ecuador’s social security governance.

The outcome of this appeal hearing may have significant implications for the governance of the IESS and the representation of its insured members, potentially impacting social security policies in Ecuador. If the appellate court rules against Moncayo, it could prompt further changes in the oversight of the IESS and illustrate the ongoing tensions between various branches of the Ecuadorian government regarding social security management.
