Supreme Court acquits driver in human smuggling case
The Danish Supreme Court has acquitted a man who assisted a Moroccan woman in entering Denmark illegally, overturning previous sentences imposed by lower courts.
On Thursday, the Danish Supreme Court decided to acquit a man who had been previously convicted of assisting a Moroccan woman in her illegal entry into Denmark through Rødbyhavn. This ruling contradicts earlier judgments from the Østre Landsret and the Nykøbing Falster court, which had sentenced the 40-year-old French citizen, living in Norway, to a six-year entry ban and 30 days in prison. The Supreme Court found that the man did not intend to violate the law by giving the woman a ride as a passenger in his car, significantly altering the legal landscape for similar cases.
The case revolved around events from four years prior, when the man arrived at Rødbyhavn early in the morning of January 2, 2022, with his wife and another individual whom he had picked up in Germany via the carpooling platform BlaBlaCar. The situation escalated after it became known that one of the passengers was accompanied by a woman, raising legal questions about the driver’s knowledge and intent regarding the illegal entry of the Moroccan woman. The Supreme Court's decision emphasizes the necessity to assess each case of alleged smuggling and the intention behind the actions rather than a blanket application of the law.
This ruling not only impacts the individual involved but also sets a precedent for future cases regarding human smuggling in Denmark, pointing to a potential shift in how authorities might approach similar instances. It reinforces the importance of intent in legal judgments, indicating that those assisting others may not always be guilty of smuggling, especially if they lack malicious intent or knowledge of the law violations being facilitated. The man's acquittal allows him to continue visiting Denmark for work without the burden of legal restrictions, a significant relief for him and a likely point of reference for others in similar circumstances.
