The acquittal was announced following a legal action initiated by the Public Defender's Office of Mato Grosso, which argued that the original conviction was based solely on an irregular photo and in-person identification, lacking supporting evidence linking the accused to the crime.

The STJ's ruling, dated March 2, emphasized that the identification of the suspect did not comply with the procedures outlined in Brazil's Code of Criminal Procedure (CPP), which is designed to minimize errors in suspect identification. Minister Og Fernandes, who signed the decision, highlighted the importance of adhering to these legal standards to ensure just outcomes in criminal cases.

The robbery itself occurred in October 2020 on a public street in Várzea Grande, a city in Mato Grosso.
