In a new trial, the Justice of MG maintains conviction for the rape of a 12-year-old girl

A court in Minas Gerais upheld the conviction of a 35-year-old man for the rape of a 12-year-old girl.

The 9th Criminal Chamber of the Court of Justice of Minas Gerais upheld the conviction of a 35-year-old man accused of raping a 12-year-old girl in Indianópolis, located in the Triângulo Mineiro region. The decision was made unanimously during a session held via videoconference, affirming the lower court's penalty despite prior attempts at appeal by the defense. Additionally, the conviction of the victim's mother for omission was also confirmed by the court.

The judges considered appeals filed by the Public Prosecutor's Office against a previous ruling that had initially absolved the defendants of a sentence slightly over nine years in prison. This recent judgment overrules an earlier decision by Judge Magid Nauef Láuar, who had unilaterally annulled the ruling of acquittal associated with his own report. The case garnered attention particularly after Judge Láuar was removed by the National Justice Council (CNJ) due to allegations of sexual harassment, leading to a reassignment of the case to Judge José Xavier Magalhães Brandão.

This ruling marks an important step in the quest for justice in cases of sexual violence against minors in Brazil, highlighting not only the judicial system's response to such crimes but also shedding light on the complexities involved in prosecuting cases of vulnerable victims. The outcome could have implications for future legal proceedings in similar cases, emphasizing the need for stringent enforcement of laws protecting children from sexual abuse.
