Court of Justice of Minas Gerais maintains conviction of 35-year-old man accused of raping 12-year-old girl in Indianópolis

The Court of Justice of Minas Gerais upheld the conviction of a 35-year-old man found guilty of raping a 12-year-old girl, alongside a ruling against the girl's mother for neglect.

The 9th Criminal Chamber of the Court of Justice of Minas Gerais (TJMG) unanimously decided to uphold the conviction of a 35-year-old man accused of raping a 12-year-old girl in Indianópolis, located in the Triângulo Mineiro region. This ruling, made during a session on November 11, extends to the girl's mother, who was also convicted for her failure to protect her daughter. The court's decision came after a successful appeal from the Public Prosecutor's Office, which challenged a prior solitary ruling and affirmed the original sentence from the first instance.

Judge José Xavier Magalhães Brandão delivered the winning vote, having become the rapporteur for the case following the recusal of Judge Magid Nauef Láuar. Joining him in the decision were judges Walner Barbosa Milward de Azevedo and Kárin Emmerich. Meanwhile, the Public Defender's Office of Minas Gerais, which represented the defendants, refrained from commenting on specific criminal cases, particularly those that are confidential.

This case highlights the ongoing issues surrounding the protection of minors and the judicial process involved in handling such serious crimes. The affirmation of the conviction serves to underline the legal system's stance against sexual violence towards children and the responsibility of guardians in safeguarding their well-being. The implications of this decision may resonate in future cases involving similar circumstances, as it emphasizes the accountability of both offenders and caregivers in the eyes of the law.
