Is it still possible to apply for many 'WZs' for one property?
The Polish Ministry of Development and Technology has proposed changes to the zoning law that would limit who can apply for construction conditions for properties, amidst high demand.
The article discusses a proposed amendment to the Polish zoning law under project UD 316, which focuses on issuing decisions regarding construction conditions, commonly referred to as 'wuzetki'. Currently, anyone can apply for a WZ for real estate, leading to multiple applications for attractive properties. In response to pressure from local governments, the Ministry aims to restrict applications to individuals who have the right to manage the property for construction purposes.
The proposed changes are designed to streamline the application process, reducing the number of speculative applications that can burden local administration and inhibit development. The Ministry has specified that while the number of applicants is being limited, they do not intend to cap the total number of WZ decisions that can be issued for the same land, which can now be granted to multiple qualified applicants, ensuring transparency by informing all interested parties.
This legislation is significant as it reflects the ongoing challenges local authorities face in managing property development effectively while balancing public interest. By narrowing the pool of applicants, the Ministry hopes to facilitate more efficient processing of requests and ultimately support sustainable urban planning and development in Poland.
