Vierumäki Sports Institute sold travel packages to consumers without guarantees - the market court slammed the practice

The Finnish Market Court has ruled that the sports courses organized at Vierumäki are classified as travel packages that must provide a guarantee against insolvency.

The Finnish Market Court has made a decisive ruling regarding the legal status of sports courses offered by the Vierumäki Sports Institute, determining that these courses qualify as travel packages requiring proper consumer guarantees. The court emphasized that consumers must be protected against the risks of pre-paid services, especially in light of potential insolvency by the travel organizer. As part of its ruling, the court imposed a financial penalty of 100,000 euros on both the Finnish Sports Institute's Support Corporation and Vierumäki Sports Oy for failing to meet these legal requirements.

This regulatory decision reinforces the stance taken by the Consumer Ombudsman, who argued that overnight sports courses, such as yoga retreats and family-oriented activity weekends, should be treated as travel packages. This classification brings them under the jurisdiction of consumer protection regulations, which necessitate financial guarantees to protect consumer pre-payments. The ruling aims to enhance transparency in the tourism and sports education sectors and ensure that consumer rights are upheld.

Reactions to the ruling in Vierumäki have been relatively calm, with the CEO of Vierumäki companies, Jukka Tiikkaja, acknowledging the court’s decision. While the ruling prohibits the sale of pre-paid packages without proper guarantees, it does not apply to the institute's qualification programs, which remain unaffected. This delineation may bring some relief to the institute, allowing it to continue its educational services while adjusting its travel package offerings to comply with legal expectations.
