Public shelter in SP faces eviction action after paying double rent for subleased property

A public shelter for the homeless in São Paulo is facing eviction due to alleged unpaid rent, despite paying a significantly higher amount than the lease.

A public shelter in the Ipiranga neighborhood of São Paulo is undergoing eviction proceedings after its operator failed to meet rental payment obligations. The shelter, known as Centro de Acolhida Santa Terezinha, has the capacity to accommodate 600 homeless individuals and is managed by the Associação Cultural Nossa Senhora das Graças. This organization receives a monthly subsidy of R$ 645,899.89 from the city's Social Assistance Department (Smads), which includes the rental costs for the three-story building.

The rental contract was signed in September with Vaughn Administradora Ltda, led by Jhone Borges de Oliveira, for R$ 105,800 per month. However, it has been revealed that Vaughn Administradora does not own the property; rather, they have been renting it at a significantly lower rate of R$ 45,000 per month for two years. On the very day the contract was executed between the shelter and Vaughn, eviction proceedings were already in motion due to back rent owed for the months of June to September 2023.

This situation raises concerns regarding the management of public resources and the transparency in contracts related to social services in Brazil. The government's reliance on private entities for essential services such as homelessness shelters is also under scrutiny, especially in light of the financial discrepancies and challenges faced by the shelter in fulfilling its commitments. As the shelter seeks to resolve the eviction notice, it highlights broader issues of governance and social responsibility in addressing homelessness in urban areas like São Paulo.
