Citskovskis has appealed the court ruling regarding his suspension and disciplinary punishment
Citskovskis has appealed his suspension ruling, which the court deemed illegally implemented and ordered compensation for unpaid wages.
Citskovskis, a public official in Latvia, has appealed a court ruling that upheld his suspension from office. The Administrative District Court had partially satisfied his application in January, determining that the suspension was a preventive measure aimed at ensuring lawful management of public funds. However, the court later recognized that the risks associated with Citskovskis's potential misuse of funds had been mitigated by January 2024 due to action taken by the State Chancellery.
As a result, the court concluded that the State Chancellery had not appropriately assessed the necessity and proportionality of the suspension, leading to the determination that the suspension was illegal. Consequently, Citskovskis is entitled to compensation for unpaid wages and social guarantees. The court ordered the State Chancellery to compensate him an amount of 5,333 euros for the period of illegal suspension from April 10 to May 8, 2024.
This case has significant implications for public administration and accountability in Latvia, highlighting the legal boundaries of disciplinary actions against public officials and the necessity for due process in administrative decisions. The outcome may set precedents regarding the protection of public officials' rights in the context of administrative sanctions, and it emphasizes the importance of careful evaluation before implementing such drastic measures as suspension from duty.
