Court condemns construction company for death of elderly man after floor gave way during storm in the coast of SP

The São Paulo Court of Justice has ruled that a construction company must pay 100,000 Brazilian Reais to the relatives of Moisés Elias Neto, an 86-year-old man who died when the floor of his nursing home collapsed during a tempest in São Vicente, SP. The incident, which took place in March 2020, resulted in a crater approximately three meters deep in the room where Mr. Neto was staying at the time. His death was confirmed at the scene, prompting legal action from his family against the construction company responsible for the nearby building.
Family attorney João Freitas argued that structural deficiencies related to the construction of the adjacent Solaris building caused the collapse. Technical reports submitted as evidence pointed to serious issues with drainage and groundwater management which the defense contends contributed to the tragic fate of Neto. The defense for the construction company stated that it plans to appeal the court’s decision, indicating ongoing disputes regarding liability and responsibility for the incident.
