It is already known who will consider the application for an EAW for Zbigniew Ziobro

The Polish National Prosecutor's Office has requested an EAW for Zbigniew Ziobro, suspected of committing 26 crimes, which a Warsaw court confirmed as likely.

On February 10, the Polish National Prosecutor's Office submitted a request for a European Arrest Warrant (EAW) against Zbigniew Ziobro, who is currently residing in Hungary. The request stems from the suspicion that Ziobro, a member of the ruling Law and Justice party (PiS), has committed 26 offenses. The District Court for Warsaw-Mokotów has backed the likelihood of these crimes, which was a significant factor in the request for temporary arrest of Ziobro.

Recently, the Warsaw Regional Court granted a request to exclude Judge Dariusz Łubowski from adjudicating this case. This decision follows Judge Łubowski’s previous ruling in December, which dismissed a similar EAW against Marcin Romanowski, a former deputy minister of justice also sheltering in Hungary. Łubowski cited concerns about human rights violations and breaches of the constitutional order by the Polish executive authority, raising serious doubts about the judiciary's independence in Poland.

This case highlights ongoing tensions in the Polish legal system and the broader political landscape, especially regarding the rule of law and judicial independence. With both Ziobro and Romanowski obtaining asylum in Hungary, their cases raise complex questions about the implications of EU law and member states' responsibilities in upholding it, as well as domestic legal challenges in Poland under the current government.
