Justice authorizes resumption of landfill construction in the interior of Amazonas after appeal

The Amazonas Court of Justice has allowed the resumption of landfill construction in Iranduba after the company presented a viability declaration.

The Amazonas Court of Justice (TJAM) has recently authorized the resumption of landfill construction in Iranduba, a municipality located in the Metropolitan Region of Manaus. This decision was made by Judge Abraham Peixoto Campos Filho, who accepted an appeal from Norte Ambiental Tratamento de Resíduos Ltda., the company responsible for the project. Previously, construction activities, including land leveling and vegetation removal, were halted due to a preliminary injunction, which imposed a daily fine of R$ 50,000 for non-compliance.

The halt in construction was initiated following an action by the Public Ministry of the State of Amazonas (MPAM), which raised concerns about potential irregularities in the environmental licensing process. One significant issue highlighted was the lack of an environmental viability certificate from the Iranduba Municipality, a requirement set by the National Environmental Council (Conama). This legal contestation reflects broader concerns regarding environmental compliance in development projects, especially in ecologically sensitive areas like the Amazon rainforest.

In response to the legal challenges, Norte Ambiental presented a "Declaration of Viability" issued by the Municipal Environmental Secretary in 2018, demonstrating the project's alignment with environmental regulations.
