Court accepts charges and turns police investigator into defendant for the rape of a detainee in a police station in Mato Grosso

A police investigator in Brazil has been turned into a defendant after being charged with the rape of a detainee in a police station, following DNA evidence.

The 2nd Criminal Court of Sorriso in Mato Grosso, Brazil, recently accepted charges against 52-year-old civil police investigator Manoel Batista da Silva, who is suspected of raping a detainee within the police station. Following the acceptance of the charges on Friday, he now faces trial as a defendant, while the case is under judicial secrecy. Efforts are ongoing by the press to locate his legal representation for comments on the situation.

On Thursday, a report from the Official Technical Expertise and Identification (Politec) confirmed the occurrence of 'conjunction carnal' with the victim through DNA examination. This finding, however, did not directly classify the act as rape according to the technical report. Nonetheless, the civil police department conducted its own inquiry and opted to indict the investigator, moving forward with legal proceedings against him based on the investigation's findings.

The matter remains sensitive as two tests were conducted, with the first occurring just three days after the alleged incident in Sorriso. Initial examinations found no visible signs of external violence; however, Politec's director emphasized that absence of external injuries does not negate the possibility of sexual assault, underscoring the complexities of evidentiary standards in such cases. The situation raises significant concerns regarding accountability within law enforcement and the treatment of detainees under the care of police authority.
