Lawyers: Claims for Damages by Tallinn Port and TS Laevad are Not Statute-Barred

Tallinn Port and its subsidiary TS Laevad have filed a substantial damages claim against former executives and related parties, asserting that these claims are still valid despite a criminal case being dismissed due to statute of limitations.

Tallinn Port, along with its subsidiary TS Laevad, has initiated a civil lawsuit for over eight million euros against former executives and several associated parties. This action comes shortly after a criminal case involving corruption charges against the company's past leaders was terminated due to the statute of limitations. While the legal proceedings regarding the criminal charges have concluded, Tallinn Port asserts that the damage claims related to financial losses remain actionable and have not expired under the law.

On February 2, a significant corruption case against former leaders of Tallinn Port, which had been ongoing for over a decade, was dismissed based on the expiration of the statute of limitations. However, representatives from Tallinn Port clarified that this legal decision solely addressed the culpability of the individuals involved and did not affect their rights to pursue civil damages. Consequently, the port has now specifically targeted claims against Ain Kaljurand and the legal heir of deceased board member Allan Kiil, along with other involved parties, for compensation exceeding eight million euros.

The implications of this civil claim are significant, reflecting a determination by Tallinn Port to seek redress in the aftermath of corruption scandals that have previously marred its reputation. The legal arguments surrounding the validity of these damage claims in the face of a statute of limitations scenario may set important precedents for future corporate governance and accountability, particularly in Estonia's maritime sector and related legal landscapes.
