The Brazilian Electoral Court (TSE) is currently evaluating the implications of artificial intelligence (AI) technologies on the electoral process, particularly as they pertain to the upcoming elections in October. Significant concerns include the proliferation of fake nudes, the legal accountability of AI-generated influencers, and the potential utilization of smart glasses during voting. These issues raise alarms about misinformation and the integrity of the electoral process, prompting discussions around the need for regulatory adaptations to address these modern challenges.

In light of these concerns, various stakeholders, including research centers, digital law experts, and members of the Electoral General Prosecutor's Office (PGE), have proposed enhancements to existing electoral regulations. Notably, even ministers who are not part of the tribunal's core composition have contributed to this discourse. Their suggestions aim to improve the framework governing electoral practices, ensuring that the regulations evolve alongside technological advancements that could threaten the fairness of the elections.

Additionally, the TSE is considering collaborations with companies developing and supplying AI technologies to establish a task force comprised of experts dedicated to swiftly identifying manipulated content. This initiative is meant to bolster technical security in decision-making among ministers during the election campaign. Gilmar Mendes, an acting minister of the court, highlighted this recommendation during the opening session of public hearings on the matter, underscoring the TSE's proactive stance in mitigating risks associated with AI in the electoral context.
