In a controversial decision, the São Paulo Court of Justice (TJ-SP) denied a compensation claim from a couple whose cruise cabin was invaded by a naked stranger. This incident occurred during a voyage on the MSC Seaview, which set sail from Santos, São Paulo, heading towards Angra dos Reis and Búzios in Rio de Janeiro. The couple had stepped out of their cabin for recreational activities and, upon returning, they encountered an unknown individual performing indecent acts in their room.
The couple reported that when they reentered their cabin, they were shocked to find the stranger naked and behaving inappropriately on their bed. The intruder fled upon their arrival but was apprehended in the corridor by cruise security, where he was provided a sheet for modesty before being dealt with. Following this unsettling experience, the couple sought legal recourse for emotional distress and invasion of privacy caused by the incident.
Following the court's ruling against them, the couple's legal team has indicated their intent to escalate the case further by appealing to the Supreme Federal Court (STF).
