Public Prosecutor proposes that Sanepar reimburse consumers for bad taste and smell of water in Ponta Grossa
The Public Prosecutor's Office of Paraná has proposed that Sanepar reimburse residents of Ponta Grossa for issues related to bad-tasting and smelling water and pay a total indemnity of R$ 5 million.
The Public Prosecutor's Office of Paraná (MP-PR) has initiated proceedings to ensure that the Sanepar company, responsible for water supply in Ponta Grossa, reimburses residents for ongoing complaints about water quality. Following weeks of issues, which included bad taste and odor, the MP-PR has made a formal proposal through a Term of Conduct Adjustment (TAC) that includes a significant indemnity of R$ 5 million to be paid into the municipal fund designated for public benefit projects. This is indicative of significant consumer protection measures taken under Brazilian law.
Consumers affected by the poor water quality have been informed that they can seek reimbursement for auxiliary expenses incurred due to the situation, such as purchasing bottled water, as long as they provide proof of purchase. This reimbursement must be processed within 30 days from their request to Sanepar. The legal rationale behind these actions rests on violations of the Consumer Protection Code and public health regulations that mandate the provision of clear, odorless, and tasteless water to consumers.
The issue with water quality in Ponta Grossa began in January and persisted for nearly two months, prompting widespread complaints from residents. By advocating for consumer refunds and compensation, the Public Prosecutor's Office aims to hold Sanepar accountable and ensure public health standards are met, ultimately serving to strengthen consumer rights in the region.
