Nursing Assistant Sentenced for 186 Data Privacy Offenses - Illegally Accessed Patient Data of Acquaintances in Jyväskylä

A nursing assistant in Jyväskylä has been sentenced to four months of conditional imprisonment for illegally accessing the personal data of 186 individuals.

The Central Finland District Court has sentenced a nursing assistant to four months of conditional imprisonment and significant compensation for committing multiple data privacy offenses. The nursing assistant was found to have accessed the personal data of 186 individuals without authorization while working in the Central Finland welfare area. Initially, the assistant was charged with 192 data privacy offenses, though six of these charges were dismissed, highlighting the serious nature of the breaches involved.

During the trial, it was established through both written evidence and witness testimonies that the nursing assistant had conducted a substantial number of unauthorized data searches concerning the individuals involved. Many of the 192 complainants had their data accessed multiple times, with some individuals being affected nearly 30 times. The offenses occurred between April 2022 and June 2023, raising concerns about the security and management of sensitive health information in the welfare sector.

Witnesses representing the employer indicated that the nursing assistant expressed curiosity and interest as motives behind the unauthorized access. Notably, the assistant was younger than 21 years old when these offenses took place, raising questions about the oversight and compliance with data protection regulations within healthcare settings, especially regarding young employees handling sensitive information.
