Hyundai Samho has announced its willingness to negotiate with subcontractor unions under South Korea's 'Yellow Envelope Law,' recognizing its role as an 'employer' in the negotiations.
Hyundai Samho Heavy Industries, part of the HD Hyundai Group, has formally announced its readiness to negotiate with subcontractor unions in accordance with South Korea's newly revised 'Yellow Envelope Law.' This law is intended to strengthen labor rights and ensure fair negotiations between main contractors and subcontractors. The announcement indicates that Hyundai Samho recognizes its role as an employer for the purposes of these negotiations, marking a significant shift in the dynamics of labor relations within the shipbuilding industry. As a result, a scheduled hearing by the Jeonnam Labor Commission regarding Hyundai Samho’s employer status will not proceed as a consequence of this development.
The move follows demands from the metalworkers' union for collective bargaining, which were initially met with requests for further information about union members’ affiliations. The union rejected the company’s requests, concerned about potential repercussions for its members, which led to the filing of a complaint with the Jeonnam Labor Commission. In a progressive step, Hyundai Samho stated that negotiations will proceed based on the three subcontractor companies mentioned in the union’s initial requests, contingent on further review that confirms their recognition of employer status.
This development signals a broader trend in the South Korean shipbuilding sector, where negotiations between main contractors and their subcontractors are increasingly being formalized.
