KSeF and new invoice markings in JPK. There are problems, penalties may follow

New invoicing requirements linked to Poland's KSeF system are causing confusion among businesses, with many unable to comply by the upcoming deadline.

The KSeF invoicing system in Poland mandates that nearly 2 million entrepreneurs must submit compliance reports related to new invoice marking requirements. While only 5,200 companies are expected to issue invoices under KSeF currently, the deadline for sending the Jednolity Plik Kontrolny to tax authorities is rapidly approaching on March 25. This report must include either the KSeF number or one of three symbols for invoices that lack the KSeF number, creating significant challenges for many businesses.

Experts highlight that many entrepreneurs are uncertain about how to mark their invoices, especially as the deadline looms. Tax advisor Magdalena MichaΕ‚owska-Otrzonsek notes that not all accounting systems have been updated to meet these new requirements, with many software updates only becoming available in recent days. This situation is causing widespread anxiety among business owners who fear penalties for non-compliance.

As the KSeF implementation progresses, the government faces criticism over the lack of clear communication and support to assist businesses in adjusting to these changes. With many businesses still in the dark about compliance, the potential for fines looms large, adding to the already challenging landscape for small and medium-sized enterprises in Poland.
