Gilmar Mendes cancels the confidentiality breach of the Arleen fund approved by the Organized Crime CPI

Minister Gilmar Mendes of the Supreme Federal Court annulled the confidentiality breach of the Arleen fund, stating that such breaches should be individualized and not approved en masse.

On Thursday (19), Minister Gilmar Mendes of Brazil's Supreme Federal Court (STF) annulled the decision made by the Organized Crime Parliamentary Inquiry (CPI) to breach the confidentiality of the Arleen fund. Mendes emphasized that confidentiality breaches are exceptional measures that do not inherently form part of standard investigative acts. He insisted that each instance of such a breach must be carefully considered and justified, as stipulated by constitutional requirements, highlighting the necessity of individualized analysis before approving such serious actions.

The Arleen fund is an investment fund associated with the Reag management company, which is currently under investigation linked to the scandal of Banco Master. The fund gained attention during the investigations due to its purchase of shares in the Tayayá Resort in Paraná in 2021, which were previously owned by a company belonging to the family of Minister Dias Toffoli. This connection raises significant questions about conflicts of interest and the intertwining of high-level political figures with business dealings under scrutiny for criminal activity.
