Court voids the construction permit of the solar power project based on wind power decision - solar power company to take the matter forward
Neoen Renewables Finland is appealing to the Supreme Administrative Court after a court decision revoked a construction permit for a solar power project in Orimattila.
Neoen Renewables Finland has announced plans to appeal to the Supreme Administrative Court in response to a ruling that overturned a construction permit for their solar power project in Orimattila. The city had initially granted the necessary planning decision for a solar farm that would span nearly 200 hectares in the Pakaan Uudenkartano area. However, the administrative court annulled the decision made by the Orimattila Environmental Committee, stating that the project's prerequisites should be examined through zoning processes.
The company's appeal highlights its belief that the administrative court's decision was incorrect, pointing out that it compared solar power unfavorably to wind energy in its justification for revoking the permit. Neoen claims this comparison does not adequately reflect the potential and environmental benefits of solar energy when considered alongside other forms of renewable energy.
Furthermore, Neoen has raised concerns about the rationale provided by the Hämeenlinna Administrative Court, suggesting that it closely mirrors a justification used in a decision from over a decade ago by the Supreme Administrative Court regarding wind power. This raises questions about the originality and appropriateness of the legal reasoning applied in the current case and suggests broader implications for future renewable energy developments in Finland.
