The Supreme Court did not accept the appeal of the Old Baskin Theater

The Estonian Supreme Court has declined to take up the Old Baskin Theater's appeal for operational support from the Ministry of Culture for the year 2024.

In a recent ruling, the Estonian Supreme Court declined to consider an appeal filed by the Old Baskin Theater regarding a request for operational funding from the Ministry of Culture for the year 2024. The theater, which has previously engaged in legal disputes surrounding funding from the ministry, asserted that the government should provide them with a subsidy to support their operations. However, the Supreme Court upheld a previous ruling from the Tallinn Circuit Court, which had sided with the Ministry of Culture's decision to deny the funding request.

The Old Baskin Theater had formally submitted an application to the Ministry of Culture in October 2023, seeking a grant of 165,000 euros for operational support. This application was assessed by a committee from the Ministry, which determined that the theater's request did not meet the necessary criteria for funding. According to the committee's evaluation criteria, the application fell below the required points threshold, leading to the denial of their support request.

The Supreme Court's decision highlights the challenges faced by cultural institutions in Estonia concerning funding and support from governmental bodies. It also reflects the legal framework in which such appeals are heard, as the court clarified that it will only consider cases that exhibit significant errors from lower courts that could lead to incorrect rulings or are essential for establishing consistent judicial practice. This situation underscores ongoing debates about the adequacy and accessibility of cultural funding within the country, particularly amidst a backdrop of regulatory and bureaucratic challenges.
