Court orders bank to refund customer N3.38m excess charges
A Nigerian court has ruled that Fidelity Bank Plc must refund N3.38 million to Ifeco Communications Limited for excess charges deducted from their account.
An Imo State High Court has mandated Fidelity Bank Plc to refund a total of N337,905,965 to Ifeco Communications Limited after determining that the bank wrongfully charged excessive fees from their account. The court's ruling, delivered by Justice J. M. Njaka in Owerri, highlighted that a substantial part of this amount, N327,905,965, consisted of excess charges including management fees, legal fees, and an excess charge on transactions. Additionally, the court awarded N10,000,000 in damages to the plaintiff for the undue burden caused by the bank's actions.
The case, assigned the number HOW/260/2016, involved Ifeco Communications Limited as the first plaintiff and Pretoria City Hotel and Resort Limited as the second plaintiff. The legal proceedings were initiated with the objective of declaring that Pretoria City Hotel and Resort Limited only owed Fidelity Bank Plc N101,732,109.46 based on an independent audit report. This situation arose out of claims surrounding deductions that were not justified according to the contractual agreement between the parties.
